Don't know about the legality of his flying but it is spectacular. Flying between and under the moving cars, and into the boxcar with the open door took some skill and timing. One mistake and his expensive drone would have been destroyed. Or found a hundred miles away if it had been unable to get out of the boxcar! I notice at the end he was flying it FPV, this couldn't have been done without that.
Drone flights like this shouldn't be encouraged and generally give the drone community a bad image in the eyes of business and the government. While there was no risk to the train, this kind of drone flying will only cause more restrictions to be placed on people who fly drones.

And the conductor on the train didn't seem to impressed. He was probably on the radio calling dispatch.

While I really enjoyed the video and learned a lot about what the top of box cars look like, I also showed the video to a neighbor who is into drones as much as I am into model trains. My neighbor was very upset to see the video. He thought the flight that was filmed was "illegal and irresponsible." He said guys like that give drone operators a bad reputation. He also said if Union Pacific found out that the video was posted on You Tube that they would probably track the guy down and report him to the FDA. I am not a drone guy and I don't know whether my neighbor is correct or not, but he sure was agitated.

Great flying, must have been difficult to control, but I share others questions on legality and responsibility. I don't know what, if any, laws were broken. I imagine the pilot thought it was harmless, but I don't know. Might create problems for others....

Jim I have to agree in that, I do not know the logistical legalities of this subject matter either but, I for one find this type of rail fanning to have very interesting and unique views into a new feel and way of the ability it to see and explore a moving train on the outside. As for that Conductor closing his window at the mere notice of the Drone was just instinct.... SEE.... he knew that pilot had some bit of skill and did not want to offer it him a free "CAB RIDE" so he just simply shut the window as a gesture to say nope, No way! LMAO

Jim, I had to watch the video again to make sure the video wasn't mirrored. I figured you caught something I missed. I spend so much time on the other side of the cab my head twitched when you said engineer.
